Terms of Service

Short and plain. Doctor dB is a free closed-source beta software. By using the software or this website, you agree to these terms. If you do not agree, do not use it.

Scope of these terms

These terms apply to the Doctor dB plugins (CLAP, VST3, AU), the Doctor dB Labs installer, and the doctordb.de website. They also apply to all related updates, patches, and services provided by us.

Third-party services (such as Google, Apple, GitHub, or payment providers) are governed by their own terms and are not covered here.

License (not ownership)

Doctor dB software is licensed, not sold. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the software during the beta period, free of charge.

You may not redistribute, sell, rent, sublicense, or make the software available to third parties. You may not reverse engineer, decompile, disassemble, or attempt to extract source code, except where such restrictions are prohibited by law.

Accounts, activation & access

Access to certain features may require an account and license activation. We may use account-based or device-based controls to manage usage, prevent abuse, and enforce license terms.

You are responsible for keeping your account credentials secure. We may suspend or revoke access if we detect misuse or violation of these terms.

Beta software

The software is in beta and may be unstable. It may contain bugs, produce incorrect results, crash, or change without notice. Features may be modified, removed, or added at any time.

We do not guarantee long-term availability of any feature, compatibility with future systems, or continued free access after the beta period ends.

You are responsible for backing up your work and not relying on the software for critical or production-grade use.

User content

You retain all rights to audio, projects, presets, or other content you create using Doctor dB. We do not claim ownership over your output.

We do not access your local projects or audio content unless required for technical support and only with your consent.

No warranty

The software is provided "as is" and "as available", without warranties of any kind, either express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the software will be uninterrupted, error-free, or compatible with all systems or configurations.

Limitation of liability

To the maximum extent permitted by German law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the software.

This includes, for example, loss of data, loss of profits, or system failures.

This limitation does not apply in cases of intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), or in cases of injury to life, body, or health, or under the German Product Liability Act (Produkthaftungsgesetz).

Intellectual property

All Doctor dB software, branding, logos, and related materials are owned by Dennis Oberst and protected by copyright and intellectual property laws.

No rights are granted except those explicitly stated in this agreement.

Termination

You may stop using the software at any time by uninstalling it.

We may suspend or terminate access if you violate these terms, misuse the software, or attempt to bypass license or security systems.

Upon termination, your right to use the software ends immediately.

Changes to the service and terms

We may update or modify the software, services, or these terms at any time. If changes are material, we will provide reasonable notice where possible.

Continued use of the software after changes become effective constitutes acceptance of the updated terms.

Refunds & consumer rights

If applicable under EU consumer law, you may have a statutory right of withdrawal within 14 days of purchase, unless you have explicitly waived this right (e.g. by downloading or activating digital content where legally applicable).

Refunds, if offered, are handled on a case-by-case basis unless otherwise required by law.

Governing law

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Berlin, to the extent permitted by law.
